TriSwim Ltd – Terms and Conditions

These Terms and Conditions (“Terms”) govern all services provided by TriSwim Ltd (“we”, “us”, “our”), including but not limited to swimming lessons, coaching, open water swimming sessions, video analysis, gift certificates, events, and memberships. By accessing our services, booking a session, or using our website, you are agreeing to these Terms, which form a legally binding contract.
This document is written in accordance with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, including Regulation 28(1)(h), which excludes the right to cancel leisure activities provided on a specific date or within a specific timeframe. These Terms aim to provide clarity, fairness, and legal compliance for both the service provider and the consumer.
1. Introduction
TriSwim Ltd delivers adult and junior swim coaching in pools and open water, across both individual and group formats. These Terms apply to all clients, users of our services, and website visitors. We recommend reading them thoroughly before making a booking.
2. Acceptance of Terms
You must accept these Terms when making a booking or purchase via our website or TriSwim app. By completing your booking, you confirm that you have read, understood, and agreed to be bound by these Terms. TriSwim Ltd reserves the right to amend these Terms to comply with UK law, reflect changes in operational procedures, or improve service clarity. Any material changes will be communicated via email or posted on our website.
3. Services Offered
We offer the following services:

Individual Coaching: One-to-one sessions in pool or open water.

Group Lessons: Small group sessions (e.g., 2:1, 3:1, or structured clinics).

Courses: Multiple pre-scheduled lessons forming a fixed curriculum.

Video Analysis: Technique-focused sessions recorded and reviewed by our coaches.

Open Water Sessions: Guided swims in natural venues.

Gift Certificates: Time-limited pre-paid vouchers for any of the above.

Events: Specially organised swim experiences.
4. Substitution of Coaches
If your scheduled coach is unavailable due to illness, emergency, or operational necessity, we reserve the right to appoint a qualified replacement. This ensures continuity of service and does not affect your statutory rights.
5. Booking, Scheduling & Session Validity

Bookings must be made via the TriSwim website or app and are subject to availability.

Confirmation emails are issued upon booking. It is your responsibility to check these for accuracy.

All sessions and gift vouchers are valid for 12 months from the date of purchase.

Validity periods may be extended for force majeure events, such as government-enforced lockdowns.

Please arrive no earlier than 10 minutes before your scheduled session.

Late arrivals will not result in extended session time.
6. Contact Information
It is your responsibility to provide and maintain accurate contact information. We use your details to communicate critical updates, changes, and safety notices.
7. Payments and Invoicing

Full payment is required at the time of booking.

Payments are processed via Stripe through the TriSwim app or website.

Failure to pay in advance may result in cancellation of your booking.

Electronic invoices will be sent to your registered email address. Failure to receive an invoice does not excuse non-payment.
8. Medical Conditions and Safety

You must declare all relevant medical conditions at the time of booking.

It is your responsibility to ensure you are fit to participate. We reserve the right to cancel your session if we believe there is a safety risk.

You must notify us in advance if illness affects your ability to attend.
9. Cancellation Policy
Our cancellation policy is written in accordance with the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. Under Regulation 28(1)(h), there is no statutory 14-day cooling-off period for leisure activities booked for a specific date or time. As such, all coaching sessions, courses, events, and open water swims booked through TriSwim Ltd are considered final once confirmed.
9.1 Cancellation by You

Single Sessions: Non-refundable once booked.

Packages/Courses: Non-refundable after booking confirmation.

Cancellations within 72 hours: Not eligible for refund. A reschedule may be offered at our discretion, but is not guaranteed.

Medical Cancellations: Require a doctor’s certificate and are subject to a non-refundable administration fee.

TriSwim Stars Programme: Where a swimmer experiences ongoing distress after three consecutive sessions, we may offer a pro-rata refund, minus admin fees, at our discretion.
9.2 Cancellation by TriSwim Ltd

We may cancel sessions due to coach illness, venue closures, adverse weather, or safety concerns.

We will offer you an alternative date or suitable replacement within your 12-month validity period.

A full refund will only be provided if:

No reasonable alternative is available, and
-
You have actively attempted to reschedule within the original 12-month period.
-
Failure to engage with reasonable efforts to rebook does not entitle you to a refund.
10. Gift Certificates

Valid for 12 months from the date of purchase.

Non-refundable once purchased, in line with our cancellation policy for leisure activities.
-
If a session is cancelled by us, a replacement will be offered within the 12-month validity.

Refunds are only considered after 12 months if:

The client made consistent, reasonable attempts to reschedule, and
-
TriSwim Ltd was unable to provide a suitable alternative.

Gift certificates that expire due to client inactivity or failure to communicate will not be refunded.
11. Memberships
TriSwim offers annual and monthly memberships via the GloFox platform:

Annual Memberships:

Automatically renew every 365 days.

Email reminders will be sent 30 days and 7 days before renewal.

Cancellations must be made via the TriSwim app or by emailing info@triswim.org.uk.

Monthly Memberships:

Renew every 30 days.

You may cancel at any time by emailing info@triswim.org.uk.

Cancellations must be submitted before the next billing date.

We aim to acknowledge all cancellation requests within 7 days.

12. Photography and Video Consent

We may capture photography and video footage during all sessions, including pool, open water, and events.

By attending, you consent to the use of your image in marketing, social media, and training materials.

If you do not wish to be photographed, please notify us in writing before your session.
-
You may request the retrospective removal of your image from any public platform at any time.
-
Video analysis content is the intellectual property of TriSwim Ltd and must not be copied, shared, or distributed without written consent.
13. Behaviour and Venue Conduct

Respectful, safe conduct is required at all times.

Children must be supervised by a parent or guardian.
-
Running, inappropriate behaviour, and nudity are not permitted in any TriSwim venue.

Consumption of alcohol or drugs is strictly prohibited.

Only one car per swimmer is permitted in designated parking areas. Park at your own risk.
14. Limitation of Liability

We accept no responsibility for loss or theft of personal property, including in changing rooms, poolside areas, or open water venues.

We are not liable for damage to or theft from vehicles in our car parks.
-
We do not reimburse costs incurred due to cancelled sessions, including travel, accommodation, or other third-party expenses.
-
Our liability is limited to direct losses caused by proven negligence.

All claims must be submitted in writing within 6 months of the incident.
15. Governing Law
These Terms are governed by and interpreted under the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the English courts.
16. Privacy Policy
We comply with the UK General Data Protection Regulation (UK GDPR). Your data is only used for legitimate business and communication purposes in accordance with our Privacy Policy.
